Terms of Service

1. Acceptance
By accessing or using the Gertin AI platform ("Service") provided by Gertin AI, Inc. ("Gertin," "we," "us"), you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of an organization, you represent that you have authority to bind that organization.
2. Service Description
The Service provides AI-powered compliance and security analysis APIs including IAM policy analysis, cloud misconfiguration scanning, SOC2 evidence evaluation, log summarization, and threat explanation. The Service is deployed within your AWS environment and processes data using AWS Bedrock.
3. Acceptable Use
You may use the Service for lawful compliance, security analysis, and related business purposes. You may not use the Service to: (a) violate any applicable law or regulation; (b) transmit malware, harmful code, or unauthorized access credentials; (c) attempt to reverse-engineer or extract model weights or proprietary algorithms; (d) resell or sublicense the Service without express written permission; or (e) circumvent rate limits, authentication mechanisms, or other technical controls.
4. Subscription and Payment
Subscription fees are billed monthly or annually as selected at the time of purchase. Annual subscriptions are non-refundable except as required by applicable law or as specified in our refund policy. We reserve the right to suspend access for non-payment after a 10-day grace period. Price changes will be communicated with 30 days notice.
5. Data Ownership
You retain all ownership rights to the data, policies, configurations, and logs you submit to the Service. Gertin claims no ownership, license, or rights to your compliance data. As described in the Privacy Policy, compliance data is processed in-memory within your AWS account and is not stored by Gertin.
6. Service Level
Enterprise plan subscribers are entitled to a 99.95% monthly uptime SLA. In the event of a breach, Enterprise customers are eligible for service credits as specified in the Enterprise Service Level Agreement. Starter and Business plan subscribers are not entitled to SLA credits but benefit from best-effort availability targets.
7. Disclaimer
The Service provides AI-generated analysis for informational purposes. Gertin does not warrant that analysis output constitutes legal advice, certified audit reports, or authoritative compliance determinations. You are responsible for reviewing and validating outputs before relying on them for compliance or regulatory purposes.
8. Limitation of Liability
To the maximum extent permitted by law, Gertin's total liability for any claim arising from these terms or use of the Service is limited to the fees you paid in the 12 months preceding the claim. In no event shall Gertin be liable for indirect, incidental, consequential, or punitive damages.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under AAA Commercial Arbitration Rules, except that either party may seek injunctive relief in court for intellectual property violations.
